HTS 9903.04.70 is a Section 232 pharmaceuticals heading for articles and ingredients imported solely for clinical trials, research and development, or other non-commercial applications. As of October 2026, its stated rate is the duty in the applicable subheading plus 0%, effective September 29, 2026. It adds no tariff of its own: it is a claim heading that tells CBP the goods fall in this non-commercial category.

What 9903.04.70 is and what changed

The code sits in subchapter III of Chapter 99 and belongs to the Pharmaceuticals 232 program. The official heading text reads: "Pharmaceutical articles and associated ingredients provided for in subdivision (c) of U.S. note 40 to this subchapter that are solely for use in clinical trials, research and development, or other non-commercial applications."

The legal basis is 91 FR 60360 (FR Doc. 2026-19498), Annex I. That annex widened U.S. note 40(a) so that it now reaches 9903.04.60 through 9903.04.70, effective September 29, 2026. You can search for the notice on federalregister.gov and read the heading and note text in the official Harmonized Tariff Schedule.

Affected products and HTS coverage

What the heading describes

The heading covers two groups of goods, both tied to subdivision (c) of U.S. note 40:

In both cases the goods must be "solely" for use in clinical trials, research and development, or other non-commercial applications. A shipment that is partly commercial does not fit the wording of the heading.

What the facts do not tell you

The heading text does not list the underlying chapter 1 to 97 subheadings, and it names no country condition. The scope of subdivision (c), and any documentation CBP expects for a non-commercial claim, are set out in U.S. note 40. Confirm both in the current HTSUS or with your broker before filing.

Rate and effective date

The rate line for 9903.04.70 reads: the duty provided in the applicable subheading + 0%. That means the Section 232 pharmaceuticals component of the duty bill for these goods is 0%. The ordinary duty for the product's regular classification still applies as it normally would.

The effective date is September 29, 2026. No end date appears in the facts for this heading. If your entry date is close to that date or you are reviewing earlier entries, check the current HTSUS and the Federal Register notice for the entry-date treatment.

This is an exemption-type heading. It does not impose a surcharge, and it should not be read as one.

Interaction with other Section 232 pharmaceutical headings

The widening of U.S. note 40(a) put 9903.04.70 in the same block as the other headings from 9903.04.60 through 9903.04.70. Each heading in that block has its own condition. Pick the one that matches the facts of the shipment, not the one with the most convenient rate. Our related explainers cover the neighboring headings:

For the onshoring plan and MFN-pricing mechanics that apply to other headings in the block, read U.S. note 40 in the HTSUS. Those conditions are not part of the 9903.04.70 heading text, so do not assume they transfer to it.

How it appears on an entry

As with other Chapter 99 provisions, 9903.04.70 is reported as its own line alongside the regular chapter 1 to 97 line for the same goods. The chapter 1 to 97 line carries the normal classification and its duty. The Chapter 99 line records the Section 232 treatment. Your broker's entry software and the current CBP guidance on cbp.gov govern the exact reporting format.
